IMPORTANT: PaxCloudVPN is a NON-COMMERCIAL, EXPERIMENTAL BETA SERVICE operated as a personal technical portfolio project. This service is 100% FREE, has NO SUBSCRIPTION FEES, NO MONETIZATION, and NO REVENUE. This is NOT a registered business, company, or commercial offering. The service is provided "AS-IS" for testing and educational purposes only and may be discontinued at any time without notice or liability.
🚨 Limitation of Liability
YOU ASSUME ALL RISK. By using this service, you acknowledge that you are solely responsible for your own actions, legal compliance, and any consequences arising from your use of this VPN service. The operator accepts NO LIABILITY for any damages, legal issues, data loss, service interruptions, or any other consequences of using this service.
1. Acceptance of Terms
By accessing or using PaxCloudVPN ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Service.
These Terms constitute a legally binding agreement between you (the "User") and the operator of PaxCloudVPN.
2. Nature of the Service
2.1 Non-Commercial Beta Project
PaxCloud is:
- A personal technical project for learning and portfolio purposes
- NOT a registered business, LLC, corporation, or commercial entity
- NOT monetized - there are no subscription fees, payments, or revenue
- Operated by an individual as a non-profit educational endeavor
- Subject to termination, modification, or discontinuation at any time without notice
2.2 Beta Status
This service is in BETA, which means:
- Features may be incomplete, unstable, or subject to bugs
- Service availability is NOT guaranteed (may experience downtime)
- Features may change or be removed without warning
- Data loss, connection failures, and other issues may occur
- No service level agreements (SLAs) or uptime guarantees exist
3. User Eligibility & Account Registration
3.1 Age Requirement
You must be at least 18 years of age to use this service. By using PaxCloudVPN, you represent that you are 18 or older.
3.2 Account Security
- You are responsible for maintaining the confidentiality of your account credentials
- You are responsible for all activities that occur under your account
- You must notify us immediately of any unauthorized use of your account
- We are not liable for any losses resulting from unauthorized account access
4. Acceptable Use Policy
4.1 Permitted Use
You may use PaxCloud for:
- Privacy protection and secure internet browsing
- Testing VPN functionality for personal/educational purposes
- Accessing geo-restricted content where legally permitted
4.2 Prohibited Activities
You may NOT use PaxCloud for:
- Illegal activities: Any activity that violates local, state, federal, or international law
- Hacking or unauthorized access: Attempting to breach security, gain unauthorized access, or launch attacks (DDoS, brute force, etc.)
- Spamming: Sending unsolicited emails, messages, or engaging in spam activities
- Malware distribution: Hosting, distributing, or transmitting malware, viruses, or malicious code
- Copyright infringement: Distributing pirated content or violating intellectual property rights
- Harassment or abuse: Stalking, threatening, or harassing others
- Child exploitation: Any activity involving child sexual abuse material (CSAM)
- Terrorism or violence: Planning, promoting, or engaging in terrorism or violent extremism
- Fraud or scams: Phishing, financial fraud, identity theft, or scam operations
Violation of this policy will result in immediate account termination and may be reported to law enforcement.
5. Your Responsibilities & Legal Compliance
5.1 Sole Responsibility for Actions
YOU ARE SOLELY RESPONSIBLE FOR:
- All activities conducted through your PaxCloudVPN account and VPN connection
- Ensuring your use of the Service complies with all applicable laws in your jurisdiction
- Any legal consequences arising from your use of the Service
- Obtaining proper legal advice if you are unsure about the legality of your intended use
5.2 Jurisdiction-Specific Laws
VPN usage may be restricted or prohibited in certain countries. You are responsible for determining whether VPN use is legal in your location. Countries with VPN restrictions include (but are not limited to): China, Russia, Iran, UAE, Turkey, Belarus, Iraq, North Korea, and Turkmenistan.
By using PaxCloudVPN, you affirm that VPN usage is legal in your jurisdiction and that you will comply with all local laws.
6. No Warranties - "AS-IS" Service
THE SERVICE IS PROVIDED "AS-IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- No warranty of merchantability or fitness for a particular purpose
- No guarantee of uninterrupted, timely, secure, or error-free service
- No guarantee that the Service will meet your requirements
- No guarantee of privacy, security, or anonymity (though we make best efforts)
- No warranty regarding the accuracy or reliability of information obtained through the Service
USE OF THIS SERVICE IS ENTIRELY AT YOUR OWN RISK.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
7.1 No Liability for Damages
The operator of PaxCloudVPN shall NOT be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from:
- Your use or inability to use the Service
- Service interruptions, errors, bugs, or data loss
- Security breaches, unauthorized access, or data leaks
- Legal consequences, fines, or penalties you incur from using the Service
- Actions taken by third parties (government, ISPs, etc.) related to your VPN usage
- Loss of profits, revenue, data, or business opportunities
7.2 Third-Party Actions
We are not liable for:
- Actions taken by your internet service provider (ISP)
- Government surveillance, censorship, or legal actions
- Website blocks, service degradation, or account bans resulting from VPN use
- Data requests or subpoenas from law enforcement
7.3 Maximum Liability
In jurisdictions that do not allow the exclusion of certain warranties or limitation of liability, our liability is limited to the maximum extent permitted by law. Given that this service is free and non-commercial, our maximum liability is $0.00 USD.
8. Indemnification
You agree to indemnify, defend, and hold harmless the operator of PaxCloudVPN from any claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising from:
- Your use or misuse of the Service
- Your violation of these Terms of Service
- Your violation of any laws or regulations
- Your infringement of any third-party rights (intellectual property, privacy, etc.)
- Any content you transmit through the Service
9. Service Availability & Termination
9.1 No Guarantee of Availability
We reserve the right to:
- Modify, suspend, or discontinue the Service at any time without notice
- Terminate your account for any reason, including violation of these Terms
- Refuse service to anyone at our sole discretion
- End the beta program and shut down the service permanently
9.2 Account Termination
We may terminate your account immediately if you:
- Violate the Acceptable Use Policy
- Engage in abuse, spam, or attacks against the Service
- Provide false information during registration
- Use the Service for illegal activities
No refunds will be issued upon termination (since the service is free).
10. Intellectual Property
- The PaxCloud name, logo, and website design are the property of the operator
- The Service uses WireGuard® protocol (developed by Jason A. Donenfeld)
- You may not copy, modify, or redistribute any part of the Service without permission
11. Privacy & Data Collection
Your use of PaxCloudVPN is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
Key privacy points:
- We do NOT log VPN traffic or browsing activity
- We collect minimal account data (email, password hash)
- We may log authentication attempts for security purposes

12. Changes to These Terms
We may update these Terms of Service at any time. Changes will be effective immediately upon posting to this page with an updated "Last Updated" date. Continued use of the Service after changes constitutes your acceptance of the modified Terms.
It is your responsibility to review these Terms periodically.
13. Dispute Resolution & Governing Law
13.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States of America and the state in which the operator resides, without regard to conflict of law principles.
13.2 Informal Resolution
In the event of any dispute, you agree to first attempt to resolve the matter informally by contacting us.
13.3 Arbitration
Any disputes that cannot be resolved informally shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association (AAA).
14. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
15. Entire Agreement
These Terms of Service, together with the Privacy Policy, constitute the entire agreement between you and PaxCloud regarding the use of the Service.
16. No Commercial Relationship
BY USING THIS SERVICE, YOU ACKNOWLEDGE:
- This is NOT a commercial service, business, or paid offering
- There is NO contract for services, SLA, or customer support obligation
- The operator is an individual running a personal project, NOT a company
- You have NO expectation of service continuity, support, or compensation
